amac\u0131, kap\u0131c\u0131lar\u0131n hizmetlerinin kapsam ve niteli\u011fi ile \u00e7al\u0131\u015fma s\u00fcresi, hafta tatili, ulusal bayram ve genel tatil g\u00fcnleri, y\u0131ll\u0131k \u00fccretli izin haklar\u0131 ve kap\u0131c\u0131 konutlar\u0131na ili\u015fkin usul ve esaslar\u0131 d\u00fczenlemektir.<\/p>\n<p style=\"font-weight: 400;\"><strong>Dayanak<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 2 \u2014<\/strong>\u00a0Bu Y\u00f6netmelik, 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanununun 110 uncu maddesine dayan\u0131larak haz\u0131rlanm\u0131\u015ft\u0131r.<\/p>\n<p style=\"font-weight: 400;\"><strong>Tan\u0131mlar<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 3 \u2014<\/strong>\u00a0Bu Y\u00f6netmelikte ge\u00e7en;<\/p>\n<p style=\"font-weight: 400;\">Konut Kap\u0131c\u0131s\u0131 : Anata\u015f\u0131nmaz\u0131n bak\u0131m\u0131, korunmas\u0131, k\u00fc\u00e7\u00fck \u00e7aptaki onar\u0131m\u0131, ortak yerlerin ve d\u00f6\u015femelerin bak\u0131m\u0131, temizli\u011fi, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerde oturanlar\u0131n \u00e7ar\u015f\u0131 i\u015flerinin g\u00f6r\u00fclmesi, g\u00fcvenliklerinin sa\u011flanmas\u0131, kaloriferin yak\u0131lmas\u0131 ve bah\u00e7enin d\u00fczenlenmesi ve bak\u0131m\u0131 ve benzeri hizmetleri g\u00f6ren ki\u015fiyi,<\/p>\n<p style=\"font-weight: 400;\">\u0130\u015fveren: Konutun maliki veya ortaklar\u0131n\u0131,<\/p>\n<p style=\"font-weight: 400;\">Y\u00f6netici: \u0130\u015fveren vekili olarak hareket eden ki\u015fiyi,<\/p>\n<p style=\"font-weight: 400;\">\u0130\u015fyeri: Kap\u0131c\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 konut ile ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm, ortak yerler, eklenti ve tesislerin t\u00fcm\u00fcn\u00fc,<\/p>\n<p style=\"font-weight: 400;\">ifade eder.<\/p>\n<p style=\"font-weight: 400;\"><strong>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Yetki, G\u00f6rev ve Sorumluluklar<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Y\u00f6neticinin Yetki, G\u00f6rev ve Sorumluluklar\u0131<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 4\u00a0\u2014<\/strong>\u00a0Konut y\u00f6neticisi, \u0130\u015f Kanunu ve bu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanmas\u0131nda ve yarg\u0131 uyu\u015fmazl\u0131klar\u0131nda i\u015fverenin temsilcisidir.<\/p>\n<p style=\"font-weight: 400;\">Y\u00f6neticinin g\u00f6rev, yetki ve sorumluluklar\u0131 \u015funlard\u0131r:<\/p>\n<ol>\n<li style=\"font-weight: 400;\">a) \u0130\u015fverence kendisine yaz\u0131l\u0131 yetki verilmesi ko\u015fulu ile i\u015f ve toplu i\u015f s\u00f6zle\u015fmesi yapmak, de\u011fi\u015ftirmek ve fesh etmek,<\/li>\n<li style=\"font-weight: 400;\">b) Merkezi \u0131s\u0131tmal\u0131 kaloriferli konutlarda kap\u0131c\u0131 i\u00e7in ate\u015f\u00e7i belgesinin varl\u0131\u011f\u0131n\u0131 ara\u015ft\u0131rmak, belgesi olan\u0131 i\u015fe almak,<\/li>\n<li style=\"font-weight: 400;\">c) Kap\u0131c\u0131n\u0131n i\u015fe giri\u015finde, sa\u011fl\u0131k raporunu istemek, uygun olan\u0131 i\u015fe ba\u015flatmak ve y\u0131lda bir sa\u011fl\u0131k kontrol\u00fcn\u00fc yapt\u0131rmak,<\/li>\n<li style=\"font-weight: 400;\">d) Kap\u0131c\u0131n\u0131n \u0130\u015f Kanunu ve s\u00f6zle\u015fmesinden do\u011fan \u00fccret ve tazminat haklar\u0131n\u0131 zaman\u0131nda ve usul\u00fcne uygun olarak \u00f6demek, sigorta primlerini zaman\u0131nda yat\u0131rmak,<\/li>\n<li style=\"font-weight: 400;\">e) Konut tesisat\u0131n\u0131n kullanma bi\u00e7imiyle ilgili teknik bilgiyi yaz\u0131l\u0131 olarak kap\u0131c\u0131ya vermek ve \u00f6zelliklerine uygun olarak bak\u0131m\u0131n\u0131n yap\u0131lmas\u0131n\u0131 sa\u011flamak,<\/li>\n<li style=\"font-weight: 400;\">f) Kap\u0131c\u0131 i\u00e7in ayr\u0131lan konutun sa\u011fl\u0131k ve ya\u015fama ko\u015fullar\u0131na uygunlu\u011funu sa\u011flamak,<\/li>\n<li style=\"font-weight: 400;\">g) Kap\u0131c\u0131n\u0131n \u00e7al\u0131\u015fma ko\u015fullar\u0131 ile g\u00f6revlerini belirten bir belgeyi konut sakinlerinin bilgisine sunmak ve bu belgeyi ilgililerin g\u00f6rebilece\u011fi konutun giri\u015finde bir yere asmak,<\/li>\n<li style=\"font-weight: 400;\">h) Kap\u0131c\u0131 konutunun tahliyesi gerekti\u011finde, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu gere\u011fince, idari makamlara ba\u015fvurmak.<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>Kap\u0131c\u0131n\u0131n G\u00f6rev ve Sorumluluklar\u0131<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 5 \u2014<\/strong>\u00a0Kap\u0131c\u0131n\u0131n g\u00f6rev ve sorumluluklar\u0131 \u015funlard\u0131r:<\/p>\n<ol>\n<li style=\"font-weight: 400;\">a) Y\u00f6neticinin talimat\u0131 do\u011frultusunda konutun kaloriferini zaman\u0131nda yakmak \u0131s\u0131y\u0131 ayarlamak ve s\u00f6nd\u00fcrmek,<\/li>\n<li style=\"font-weight: 400;\">b) Hidrofor ve benzeri ara\u00e7lar\u0131 \u00e7al\u0131\u015ft\u0131rmak,<\/li>\n<li style=\"font-weight: 400;\">c) Anata\u015f\u0131nmaz\u0131n ortak yerlerini ve tesislerini temiz bulundurmak, demirba\u015flar\u0131n\u0131, ara\u00e7 ve gere\u00e7lerini, d\u00fczenli, bak\u0131ml\u0131 ve i\u015fler \u015fekilde tutmak,<\/li>\n<li style=\"font-weight: 400;\">d) Kendisine ayr\u0131lan konutu ba\u015fka ama\u00e7larla kullanmamak, konutu korumak, kendisi veya ailesinden birisinin konuta verece\u011fi zarar ve hasarlar\u0131 kar\u015f\u0131lamak,<\/li>\n<li style=\"font-weight: 400;\">e) Y\u00f6neticinin talimat\u0131 \u00e7er\u00e7evesinde konutun g\u00fcvenli\u011fini sa\u011flay\u0131c\u0131 \u00f6nlemleri almak,<\/li>\n<li style=\"font-weight: 400;\">f) Belirlenen saatlerde servis hizmetlerini g\u00f6rmek, \u00e7\u00f6pleri toplamak, bah\u00e7e d\u00fczenlemesi ve bak\u0131m\u0131n\u0131 yapmak,<\/li>\n<li style=\"font-weight: 400;\">g) Verilen e\u011fitimlere uygun davranmak ve koruyucu malzemeyi kullanmak,<\/li>\n<li style=\"font-weight: 400;\">h) \u0130\u015f veya toplu i\u015f s\u00f6zle\u015fmesinde belirlenen di\u011fer g\u00f6revleri yerine getirmek.<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>\u0130\u015f S\u00f6zle\u015fmesi ve \u00c7al\u0131\u015fma Ko\u015fullar\u0131<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>\u0130\u015f S\u00f6zle\u015fmesi<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 6 \u2014<\/strong>\u00a0Kap\u0131c\u0131 ile yap\u0131lan i\u015f s\u00f6zle\u015fmesinde;<\/p>\n<p style=\"font-weight: 400;\">\u0130\u015f s\u00f6zle\u015fmesinin t\u00fcr\u00fc ve \u00e7al\u0131\u015fma bi\u00e7imi ile i\u015fveren ve i\u015fyeri ad\u0131 ve adresi, kap\u0131c\u0131n\u0131n kimli\u011fi, i\u015fe ba\u015flama tarihi, yapaca\u011f\u0131 i\u015fler, temel \u00fccreti ve varsa \u00fccret ekleri, \u00fccret \u00f6deme \u015fekli ve zaman\u0131, \u00e7al\u0131\u015fma s\u00fcresi ve ara dinlenmesi, varsa \u00f6zel h\u00fck\u00fcmler, d\u00fczenleme tarihi ve taraflar\u0131n imzas\u0131 hususlar\u0131n\u0131n bulunmas\u0131 gerekir.<\/p>\n<p style=\"font-weight: 400;\"><strong>\u00c7al\u0131\u015fma S\u00fcresi ve Ara Dinlenmesi<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 7 \u2014<\/strong>\u00a0\u00c7al\u0131\u015fma s\u00fcresi genel olarak haftal\u0131k 45 saattir. Bu s\u00fcre \u00e7al\u0131\u015fma bi\u00e7imine g\u00f6re s\u00f6zle\u015fme ile azalt\u0131labilir. Ayr\u0131ca, \u0130\u015f Kanununun 63 \u00fcnc\u00fc maddesindeki s\u00fcreyi aksatmamak ko\u015fuluyla yo\u011funla\u015ft\u0131r\u0131lm\u0131\u015f \u00e7al\u0131\u015fma ili\u015fkisi de kurulabilir. \u00c7al\u0131\u015fma s\u00fcresi, kap\u0131c\u0131n\u0131n i\u015fte ge\u00e7irdi\u011fi zamand\u0131r. Kap\u0131c\u0131 konutu tahsis edilmi\u015f i\u015fyerinde \u00e7al\u0131\u015fma bi\u00e7imine g\u00f6re g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi en \u00e7ok d\u00f6rde b\u00f6l\u00fcnebilir. Ara dinlenmesi \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmaz.<\/p>\n<p style=\"font-weight: 400;\">\u00c7al\u0131\u015fma saatleri, yaz ve k\u0131\u015f saat uygulamalar\u0131 ve iklim \u015fartlar\u0131 dikkate al\u0131narak d\u00fczenlenebilir.<\/p>\n<p style=\"font-weight: 400;\"><strong>\u00dccret \u00d6demesi<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 8 \u2014<\/strong>\u00a0Konut kap\u0131c\u0131s\u0131na \u0130\u015f Kanunu h\u00fck\u00fcmlerine g\u00f6re \u00fccret \u00f6denir.<\/p>\n<p style=\"font-weight: 400;\"><strong>Hafta Tatili<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 9 \u2014<\/strong>\u00a0\u0130\u015f Kanunu ile s\u00f6zle\u015fme h\u00fck\u00fcmlerine g\u00f6re hafta tatili verilir.<\/p>\n<p style=\"font-weight: 400;\"><strong>Genel Tatil ve \u00dccreti<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 10 \u2014\u00a0<\/strong>2429 say\u0131l\u0131 Ulusal Bayram ve Genel Tatiller Hakk\u0131nda Kanunda yer alan tatil g\u00fcnlerinde, kap\u0131c\u0131n\u0131n \u00e7al\u0131\u015ft\u0131r\u0131l\u0131p \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131 i\u015f veya toplu i\u015f s\u00f6zle\u015fmelerinde belirlenir.<\/p>\n<p style=\"font-weight: 400;\">Bu g\u00fcnlere ili\u015fkin \u00fccretler, \u0130\u015f Kanununun 47 nci maddesine uygun olarak \u00f6denir.<\/p>\n<p style=\"font-weight: 400;\"><strong>Y\u0131ll\u0131k \u00dccretli \u0130zin<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde l1 \u2014<\/strong>\u00a0Kap\u0131c\u0131ya \u0130\u015f Kanunu h\u00fck\u00fcmlerine g\u00f6re y\u0131ll\u0131k \u00fccretli izin kulland\u0131r\u0131l\u0131r.<\/p>\n<p style=\"font-weight: 400;\"><strong>Ge\u00e7ici Kap\u0131c\u0131<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 12 \u2014<\/strong>\u00a0Kap\u0131c\u0131 y\u0131ll\u0131k \u00fccretli izin, hastal\u0131k izni veya tatil g\u00fcnlerinde g\u00f6revinden ayr\u0131ld\u0131\u011f\u0131nda yerine ge\u00e7ici kap\u0131c\u0131 \u00e7al\u0131\u015ft\u0131r\u0131labilir.<\/p>\n<p style=\"font-weight: 400;\">Ge\u00e7ici kap\u0131c\u0131ya asgari \u00fccretin alt\u0131nda \u00fccret \u00f6denemez.<\/p>\n<p style=\"font-weight: 400;\"><strong>D\u00d6RD\u00dcNC\u00dc B\u00d6L\u00dcM<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Kap\u0131c\u0131 Konutu<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Kap\u0131c\u0131 Konutu ve Tahliyesi<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde l3\u2014<\/strong>\u00a0<em>Kap\u0131c\u0131ya g\u00f6revi nedeniyle konut verilmesi zorunlu de\u011fildir.<\/em><strong><sup>\u00a0(1)<\/sup><\/strong><\/p>\n<p style=\"font-weight: 400;\">Kap\u0131c\u0131ya g\u00f6revi nedeniyle konut verilmi\u015fse, konutun 3194 say\u0131l\u0131 \u0130mar Kanunu ve Belediye \u0130mar Y\u00f6netmelikleri ile \u00f6ng\u00f6r\u00fclen asgari ko\u015fullara uygun olmas\u0131 gerekir.<\/p>\n<p style=\"font-weight: 400;\">Kap\u0131c\u0131ya, g\u00f6revi nedeniyle verilmi\u015f olan konut i\u00e7in i\u015f s\u00f6zle\u015fmesinin devam\u0131 s\u00fcresince kira istenemez.<\/p>\n<p style=\"font-weight: 400;\">Kap\u0131c\u0131n\u0131n su, elektrik, \u0131s\u0131nma ve s\u0131cak su giderlerine k\u0131smen ya da tamamen kat\u0131l\u0131p kat\u0131lmayaca\u011f\u0131 s\u00f6zle\u015fme ile belirlenir.<\/p>\n<p style=\"font-weight: 400;\">Kap\u0131c\u0131 konutunun bo\u015falt\u0131lmas\u0131nda, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanununun Ek 2 nci maddesi h\u00fck\u00fcmleri uygulan\u0131r. Bu konuda i\u015f veya toplu i\u015f s\u00f6zle\u015fmesinden do\u011fan haklar sakl\u0131d\u0131r.<\/p>\n<p style=\"font-weight: 400;\"><strong>BE\u015e\u0130NC\u0130 B\u00d6L\u00dcM<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Y\u00fcr\u00fcrl\u00fc\u011fe \u0130li\u015fkin H\u00fck\u00fcmler<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Y\u00fcr\u00fcrl\u00fck<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde l4 \u2014<\/strong>\u00a0Bu Y\u00f6netmelik yay\u0131m\u0131 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girer.<\/p>\n<p style=\"font-weight: 400;\"><strong>Y\u00fcr\u00fctme<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Madde 15 \u2014<\/strong>\u00a0Bu Y\u00f6netmelik h\u00fck\u00fcmlerini \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131 y\u00fcr\u00fct\u00fcr.<\/p>\n<p style=\"font-weight: 400;\">_________<\/p>\n<p style=\"font-weight: 400;\"><em><sup>(1)\u00a0<\/sup><\/em><em>Dan\u0131\u015ftay Onuncu Dairesinin 13\/3\/2007 tarihli ve E.:2004\/6952, K.:2007\/946 say\u0131l\u0131 karar\u0131 ile bu Y\u00f6netmeli\u011fin 13 \u00fcnc\u00fc maddesinde yer alan \u201cKap\u0131c\u0131ya g\u00f6revi nedeniyle konut verilmesi zorunlu de\u011fildir.\u201d h\u00fckm\u00fc iptal edilmi\u015ftir. Tan\u0131mlar Madde 3 \u2014\u00a0Bu Y\u00f6netmelikte ge\u00e7en; Konut Kap\u0131c\u0131s\u0131 : Anata\u015f\u0131nmaz\u0131n bak\u0131m\u0131, korunmas\u0131, k\u00fc\u00e7\u00fck \u00e7aptaki onar\u0131m\u0131, ortak yerlerin ve d\u00f6\u015femelerin bak\u0131m\u0131, temizli\u011fi, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerde oturanlar\u0131n \u00e7ar\u015f\u0131 i\u015flerinin g\u00f6r\u00fclmesi, g\u00fcvenliklerinin sa\u011flanmas\u0131, kaloriferin yak\u0131lmas\u0131 ve bah\u00e7enin d\u00fczenlenmesi ve bak\u0131m\u0131 ve benzeri hizmetleri g\u00f6ren ki\u015fiyi, \u0130\u015fveren: Konutun maliki veya ortaklar\u0131n\u0131, Y\u00f6netici: \u0130\u015fveren vekili olarak hareket eden ki\u015fiyi, \u0130\u015fyeri: Kap\u0131c\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 konut ile ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm, ortak yerler, eklenti ve tesislerin t\u00fcm\u00fcn\u00fc, ifade eder. \u0130K\u0130NC\u0130 B\u00d6L\u00dcM Yetki, G\u00f6rev ve Sorumluluklar Y\u00f6neticinin Yetki, G\u00f6rev ve Sorumluluklar\u0131 Madde 4\u00a0\u2014\u00a0Konut y\u00f6neticisi, \u0130\u015f Kanunu ve bu Y\u00f6netmelik h\u00fck\u00fcmlerinin uygulanmas\u0131nda ve yarg\u0131 uyu\u015fmazl\u0131klar\u0131nda i\u015fverenin temsilcisidir. Y\u00f6neticinin g\u00f6rev, yetki ve sorumluluklar\u0131 \u015funlard\u0131r: a) \u0130\u015fverence kendisine yaz\u0131l\u0131 yetki verilmesi ko\u015fulu ile i\u015f ve toplu i\u015f s\u00f6zle\u015fmesi yapmak, de\u011fi\u015ftirmek ve fesh etmek, b) Merkezi \u0131s\u0131tmal\u0131 kaloriferli konutlarda kap\u0131c\u0131 i\u00e7in ate\u015f\u00e7i belgesinin varl\u0131\u011f\u0131n\u0131 ara\u015ft\u0131rmak, belgesi olan\u0131 i\u015fe almak, c) Kap\u0131c\u0131n\u0131n i\u015fe giri\u015finde, sa\u011fl\u0131k raporunu istemek, uygun olan\u0131 i\u015fe ba\u015flatmak ve y\u0131lda bir sa\u011fl\u0131k kontrol\u00fcn\u00fc yapt\u0131rmak, d) Kap\u0131c\u0131n\u0131n \u0130\u015f Kanunu ve s\u00f6zle\u015fmesinden do\u011fan \u00fccret ve tazminat haklar\u0131n\u0131 zaman\u0131nda ve usul\u00fcne uygun olarak \u00f6demek, sigorta primlerini zaman\u0131nda yat\u0131rmak, e) Konut tesisat\u0131n\u0131n kullanma bi\u00e7imiyle ilgili teknik bilgiyi yaz\u0131l\u0131 olarak kap\u0131c\u0131ya vermek ve \u00f6zelliklerine uygun olarak bak\u0131m\u0131n\u0131n yap\u0131lmas\u0131n\u0131 sa\u011flamak, f) Kap\u0131c\u0131 i\u00e7in ayr\u0131lan konutun sa\u011fl\u0131k ve ya\u015fama ko\u015fullar\u0131na uygunlu\u011funu sa\u011flamak, g) Kap\u0131c\u0131n\u0131n \u00e7al\u0131\u015fma ko\u015fullar\u0131 ile g\u00f6revlerini belirten bir belgeyi konut sakinlerinin bilgisine sunmak ve bu belgeyi ilgililerin g\u00f6rebilece\u011fi konutun giri\u015finde bir yere asmak, h) Kap\u0131c\u0131 konutunun tahliyesi gerekti\u011finde, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu gere\u011fince, idari makamlara ba\u015fvurmak. Kap\u0131c\u0131n\u0131n G\u00f6rev ve Sorumluluklar\u0131 Madde 5 \u2014\u00a0Kap\u0131c\u0131n\u0131n g\u00f6rev ve sorumluluklar\u0131 \u015funlard\u0131r: a) Y\u00f6neticinin talimat\u0131 do\u011frultusunda konutun kaloriferini zaman\u0131nda yakmak \u0131s\u0131y\u0131 ayarlamak ve s\u00f6nd\u00fcrmek, b) Hidrofor ve benzeri ara\u00e7lar\u0131 \u00e7al\u0131\u015ft\u0131rmak, c) Anata\u015f\u0131nmaz\u0131n ortak yerlerini ve tesislerini temiz bulundurmak, demirba\u015flar\u0131n\u0131, ara\u00e7 ve gere\u00e7lerini, d\u00fczenli, bak\u0131ml\u0131 ve i\u015fler \u015fekilde tutmak, d) Kendisine ayr\u0131lan konutu ba\u015fka ama\u00e7larla kullanmamak, konutu korumak, kendisi veya ailesinden birisinin konuta verece\u011fi zarar ve hasarlar\u0131 kar\u015f\u0131lamak, e) Y\u00f6neticinin talimat\u0131 \u00e7er\u00e7evesinde konutun g\u00fcvenli\u011fini sa\u011flay\u0131c\u0131 \u00f6nlemleri almak, f) Belirlenen saatlerde servis hizmetlerini g\u00f6rmek, \u00e7\u00f6pleri toplamak, bah\u00e7e d\u00fczenlemesi ve bak\u0131m\u0131n\u0131 yapmak, g) Verilen e\u011fitimlere uygun davranmak ve koruyucu malzemeyi kullanmak, h) \u0130\u015f veya toplu i\u015f s\u00f6zle\u015fmesinde belirlenen di\u011fer g\u00f6revleri yerine getirmek. \u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM \u0130\u015f S\u00f6zle\u015fmesi ve \u00c7al\u0131\u015fma Ko\u015fullar\u0131 \u0130\u015f S\u00f6zle\u015fmesi Madde 6 \u2014\u00a0Kap\u0131c\u0131 ile yap\u0131lan i\u015f s\u00f6zle\u015fmesinde; \u0130\u015f s\u00f6zle\u015fmesinin t\u00fcr\u00fc ve \u00e7al\u0131\u015fma bi\u00e7imi ile i\u015fveren ve i\u015fyeri ad\u0131 ve adresi, kap\u0131c\u0131n\u0131n kimli\u011fi, i\u015fe ba\u015flama tarihi, yapaca\u011f\u0131 i\u015fler, temel \u00fccreti ve varsa \u00fccret ekleri, \u00fccret \u00f6deme \u015fekli ve zaman\u0131, \u00e7al\u0131\u015fma s\u00fcresi ve ara dinlenmesi, varsa \u00f6zel h\u00fck\u00fcmler, d\u00fczenleme tarihi ve taraflar\u0131n imzas\u0131 hususlar\u0131n\u0131n bulunmas\u0131 gerekir. \u00c7al\u0131\u015fma S\u00fcresi ve Ara Dinlenmesi Madde 7 \u2014\u00a0\u00c7al\u0131\u015fma s\u00fcresi genel olarak haftal\u0131k 45 saattir. Bu s\u00fcre \u00e7al\u0131\u015fma bi\u00e7imine g\u00f6re s\u00f6zle\u015fme ile azalt\u0131labilir. Ayr\u0131ca, \u0130\u015f Kanununun 63 \u00fcnc\u00fc maddesindeki s\u00fcreyi aksatmamak ko\u015fuluyla yo\u011funla\u015ft\u0131r\u0131lm\u0131\u015f \u00e7al\u0131\u015fma ili\u015fkisi de kurulabilir. \u00c7al\u0131\u015fma s\u00fcresi, kap\u0131c\u0131n\u0131n i\u015fte ge\u00e7irdi\u011fi zamand\u0131r. Kap\u0131c\u0131 konutu tahsis edilmi\u015f i\u015fyerinde \u00e7al\u0131\u015fma bi\u00e7imine g\u00f6re g\u00fcnl\u00fck \u00e7al\u0131\u015fma s\u00fcresi en \u00e7ok d\u00f6rde b\u00f6l\u00fcnebilir. Ara dinlenmesi \u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmaz. \u00c7al\u0131\u015fma saatleri, yaz ve k\u0131\u015f saat uygulamalar\u0131 ve iklim \u015fartlar\u0131 dikkate al\u0131narak d\u00fczenlenebilir. \u00dccret \u00d6demesi Madde 8 \u2014\u00a0Konut kap\u0131c\u0131s\u0131na \u0130\u015f Kanunu h\u00fck\u00fcmlerine g\u00f6re \u00fccret \u00f6denir. Hafta Tatili Madde 9 \u2014\u00a0\u0130\u015f Kanunu ile s\u00f6zle\u015fme h\u00fck\u00fcmlerine g\u00f6re hafta tatili verilir. Genel Tatil ve \u00dccreti Madde 10 \u2014\u00a02429 say\u0131l\u0131 Ulusal Bayram ve Genel Tatiller Hakk\u0131nda Kanunda yer alan tatil g\u00fcnlerinde, kap\u0131c\u0131n\u0131n \u00e7al\u0131\u015ft\u0131r\u0131l\u0131p \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131 i\u015f veya toplu i\u015f s\u00f6zle\u015fmelerinde belirlenir. Bu g\u00fcnlere ili\u015fkin \u00fccretler, \u0130\u015f Kanununun 47 nci maddesine uygun olarak \u00f6denir. Y\u0131ll\u0131k \u00dccretli \u0130zin Madde l1 \u2014\u00a0Kap\u0131c\u0131ya \u0130\u015f Kanunu h\u00fck\u00fcmlerine g\u00f6re y\u0131ll\u0131k \u00fccretli izin kulland\u0131r\u0131l\u0131r. Ge\u00e7ici Kap\u0131c\u0131 Madde 12 \u2014\u00a0Kap\u0131c\u0131 y\u0131ll\u0131k \u00fccretli izin, hastal\u0131k izni veya tatil g\u00fcnlerinde g\u00f6revinden ayr\u0131ld\u0131\u011f\u0131nda yerine ge\u00e7ici kap\u0131c\u0131 \u00e7al\u0131\u015ft\u0131r\u0131labilir. Ge\u00e7ici kap\u0131c\u0131ya asgari \u00fccretin alt\u0131nda \u00fccret \u00f6denemez. D\u00d6RD\u00dcNC\u00dc B\u00d6L\u00dcM Kap\u0131c\u0131 Konutu Kap\u0131c\u0131 Konutu ve Tahliyesi Madde l3\u2014\u00a0Kap\u0131c\u0131ya g\u00f6revi nedeniyle konut verilmesi zorunlu de\u011fildir.\u00a0(1) Kap\u0131c\u0131ya g\u00f6revi nedeniyle konut verilmi\u015fse, konutun 3194 say\u0131l\u0131 \u0130mar Kanunu ve Belediye \u0130mar Y\u00f6netmelikleri ile \u00f6ng\u00f6r\u00fclen asgari ko\u015fullara uygun olmas\u0131 gerekir. Kap\u0131c\u0131ya, g\u00f6revi nedeniyle verilmi\u015f olan konut i\u00e7in i\u015f s\u00f6zle\u015fmesinin devam\u0131 s\u00fcresince kira istenemez. Kap\u0131c\u0131n\u0131n su, elektrik, \u0131s\u0131nma ve s\u0131cak su giderlerine k\u0131smen ya da tamamen kat\u0131l\u0131p kat\u0131lmayaca\u011f\u0131 s\u00f6zle\u015fme ile belirlenir. Kap\u0131c\u0131 konutunun bo\u015falt\u0131lmas\u0131nda, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanununun Ek 2 nci maddesi h\u00fck\u00fcmleri uygulan\u0131r. Bu konuda i\u015f veya toplu i\u015f s\u00f6zle\u015fmesinden do\u011fan haklar sakl\u0131d\u0131r. BE\u015e\u0130NC\u0130 B\u00d6L\u00dcM Y\u00fcr\u00fcrl\u00fc\u011fe \u0130li\u015fkin H\u00fck\u00fcmler Y\u00fcr\u00fcrl\u00fck Madde l4 \u2014\u00a0Bu Y\u00f6netmelik yay\u0131m\u0131 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girer. Y\u00fcr\u00fctme Madde 15 \u2014\u00a0Bu Y\u00f6netmelik h\u00fck\u00fcmlerini \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakan\u0131 y\u00fcr\u00fct\u00fcr. _________ (1)\u00a0Dan\u0131\u015ftay Onuncu Dairesinin 13\/3\/2007 tarihli ve E.:2004\/6952, K.:2007\/946 say\u0131l\u0131 karar\u0131 ile bu Y\u00f6netmeli\u011fin 13 \u00fcnc\u00fc maddesinde yer alan \u201cKap\u0131c\u0131ya g\u00f6revi nedeniyle konut verilmesi zorunlu de\u011fildir.\u201d h\u00fckm\u00fc iptal edilmi\u015ftir.
